CLIENT AGREEMENT
If you have received a digital PDF proposal, please tick the box next to each item you require, digitally sign your name at the bottom, and return the proposal to emily@iamemily.co.uk. Your digital signature, achieved by typing your name in the provided box, is legally binding and equivalent to your handwritten signature. By digitally signing, you agree to enter into a contract with I am Emily Design & Marketing to complete the works detailed in the proposal.
If you have received an email quote, please respond in writing that you wish to proceed with the project and specify the elements you agree to. Agreement over email constitutes a legally binding contract with I am Emily Design & Marketing to complete the works detailed.
VAT INFORMATION
I am Emily Design & Marketing is not VAT registered. Therefore, all costs and expenses invoiced by I am Emily Design & Marketing are not subject to VAT charges. However, other products and services used as part of your project may incur VAT, which can be invoiced directly if your company is VAT registered and wishes to claim it back.
PAYMENT TERMS
Deposit: A 50% deposit is required for all new clients before the project commences. For subsequent projects, a 25% deposit is required unless agreed otherwise.
Balance: The remaining balance is payable within 14 days from the invoice date. This policy protects both parties, especially when working with small businesses.
Hourly Charges: If the work is carried out on an hourly basis, time sheets can be provided upon request. The estimate is based on a fair rate, and any additional costs will be notified to you.
Cancellation: In case of cancellation after the job has commenced, you will be charged for the hours worked from the start date until the cancellation date. These hours will be invoiced and must be paid within 14 days of the invoice receipt.
Debt Collection: If payment requires chasing through a debt collection agency, any costs incurred will be charged to you, in accordance with The Late Payment of Commercial Debts Act 1998 (updated in 2013).
PROJECT SCHEDULING & DEADLINES
Once your work is scheduled, you will be informed of the timelines and deadlines. We strive to complete and hand over projects on time and within budget. However, we cannot be held accountable for delays or costs caused by third parties outside the I am Emily Design & Marketing team.
NOTICE OF CANCELLATION
We require one full calendar month's notice in writing if you wish to cancel an ongoing project, retainer, or management plan.
USE OF COMPLETED WORK
Upon project completion, we may showcase the work on our website and/or social media channels. If you prefer we do not share your project, please notify us in writing at hello@iamemily.co.uk.
DATA PROTECTION & GDPR COMPLIANCE
In accordance with the Data Protection Act (DPA) and the General Data Protection Regulation (GDPR), we will keep your details within our CRM system for communication related to your current project, future projects, or ongoing management. You have the right to request the details we hold about you and can ask to be removed from our database at any time. All sensitive information, including passwords, is stored in password-protected cloud-based systems accessible only by authorised team members. We will not add you to our email marketing database unless you opt-in. We never sell your details and only share them with third parties if necessary for your project and with your permission.
